Privacy Policy in Respect of Personal Data

The Personal Data Protection Act 2010 (as may be amended from time to time, hereinafter referred to as the “Act”), which regulates the processing of personal data in commercial transactions, applies to RideNow Sdn. Bhd. and our related companies, affiliates, service providers, business partners and representatives (hereinafter collectively referred to as “RideNow”, “our”, “us” or “we”). For the purpose of this Privacy Policy, the terms “personal data” and “processing” shall have the meaning prescribed in the Act.

This Privacy Policy applies to any person whose personal data is processed by us, including but not limited to users, sellers, dealers, customers, business partners and service providers, and describes our practices in respect of the gathering, storing, dissemination, processing and disposal of such personal data.

This Privacy Policy applies to all operations, services and business activities of RideNow, including but not limited to our website, platform, motorcycle valuation services, inspection arrangements, dealer bidding process, ownership transfer facilitation and any related services.

Please read this Privacy Policy to understand how we use and process the personal data we have collected or may collect from you.

By providing your personal data to us, accessing and/or using our website, platform and/or services, you are consenting to this Privacy Policy and the collection, use, access, transfer, storage and processing of your personal data described in this Privacy Policy as modified from time to time by RideNow.

Any changes to this Privacy Policy will be updated on our website and/or platform. Any such revised Privacy Policy will continue to apply to all personal data that has previously been collected as well as information that has been stored or processed on an ongoing basis by RideNow. Therefore, you are encouraged to check the version of the Privacy Policy whenever you visit our website or platform for any updates or changes.

If you are under 18 years of age, you should ensure that you obtain the consent of your parents or legal guardian before using our services and/or platform. If you are a firm, corporation or entity supplying personal data of your directors, shareholders, employees, officers, representatives and/or other persons to us, please ensure that you have obtained their consent and brought this Privacy Policy to their attention.

This Privacy Policy sets out:

TYPE OF PERSONAL DATA

Personal data refers to any information in respect of commercial transactions that relates directly or indirectly to you, including any sensitive personal data and expression of opinion about you. Sensitive personal data refers to any personal data as to your physical or mental health or condition, your political opinions, your religious beliefs or other beliefs of a similar nature, the commission or alleged commission by you of any offence, biometric data or any other personal data as may be determined by law from time to time

The personal data collected and processed by RideNow may include (but is not limited to) the following:

  • contact information such as your name, NRIC/passport number, date of birth, gender, nationality, address, contact number, email address, username and password;
  • motorcycle-related information such as motorcycle registration number, model, make, year of manufacture, ownership information, photographs, inspection records, valuation information and/or supporting documents;
  • transaction and payment information such as bank account details, financing information, loan settlement details and/or payment history;
  • information relating to motorcycle inspection appointments, bidding activities, ownership transfer and/or transaction processing;
  • communications, enquiries, complaints, feedback and/or correspondence between you and RideNow;
  • photographs, videos and recordings collected during inspection, collection and/or transaction processes;
  • information submitted by you through our website, platform, forms, customer support channels or communication platforms; and
  • any other personal data submitted or made available by you to us from time to time.

If the need arises, we will obtain explicit consent from you to process sensitive personal data. We may however process personal data without your consent in limited circumstances as permitted under applicable laws.

SOURCE OF PERSONAL DATA

We may collect personal data from various sources, including but not limited to:

  • registration or submissions made through RideNow’s website or platform;
  • motorcycle valuation submissions and inspection booking forms;
  • documents and information provided by you;
  • communications made with RideNow through telephone calls, WhatsApp, email, social media or customer support channels;
  • participation in surveys, campaigns, promotions or programmes organised by RideNow;
  • commencement of any business or commercial relationship with RideNow; and/or
  • use of our services and platform.

We may also obtain your personal data from:

  • participating dealers, business partners and service providers;
  • financial institutions or financing companies;
  • government or regulatory authorities including JPJ, PDRM or other authorities lawfully authorised to disclose such information;
  • publicly available sources;
  • cookies and website analytics tools; and
  • any other sources where disclosure is permitted by law.

PURPOSE OF PROCESSING PERSONAL DATA

We may use and process your personal data for one or more of the following purposes:

  • to verify your identity
  • to verify your ownership of the motorcycle;
  • to process your application, submission or request for our services;
  • to provide motorcycle valuation, inspection and transaction-related services;
  • to facilitate dealer bidding processes;
  • to administer, manage and maintain our website, platform and services;
  • to coordinate inspection appointments, collection arrangements and ownership transfer processes;
  • to facilitate loan settlement and payment processing where applicable;
  • to investigate, process and resolve any complaints, disputes or enquiries;
  • to communicate with you regarding our services, updates and transaction status;
  • to produce data, reports and statistics which shall be anonymised or aggregated in a manner that does not identify you as an individual;
  • for internal and marketing activities;
  • to maintain records required for legal, operational and security purposes;
  • to improve and develop our services, systems and customer experience;
  • to detect and prevent fraud, misuse or unauthorised activities;
  • to comply with legal and regulatory obligations; and
  • for any other purposes related or incidental for the foregoing purposes, or otherwise permitted or required under applicable laws and regulations.

RETENTION AND DISPOSAL PRINCIPLE

RideNow shall take all reasonable steps to ensure that:

  • Personal Data, whether stored electronically or in physical form, is secured against risks of loss, destruction, misuse, modification, unauthorised access, disclosure or duplication by implementing appropriate data retention, classification and security measures in accordance with legal, regulatory and business requirements.
  • Documents and records containing Personal Data shall be disposed of, destroyed, deleted or anonymised as soon as it is reasonable to assume that the purpose for which the Personal Data was collected is no longer being served by such retention, unless retention is otherwise required by applicable laws, regulations or operational requirements. RideNow may periodically review the duration and purpose for which Personal Data is retained and maintain records relating to such disposal where appropriate.

DISCLOSURE OF PERSONAL DATA

We may disclose your personal data to the following third parties:

  • participating motorcycle dealers involved in the bidding or transaction process;
  • inspection providers, logistics partners, towing providers and operational service providers;
  • banks, financing institutions and payment gateway providers;
  • professional advisers, auditors, contractors and consultants;
  • government agencies, law enforcement authorities and regulatory bodies;
  • RideNow’s related companies, affiliates and business partners; and
  • any other party where disclosure is required or permitted by law.

RideNow shall be entitled to retain all data and information supplied by you for the use of RideNow notwithstanding the termination or suspension of our services to you, in compliance with legal and regulatory obligations.

Your personal data may be transferred to, stored or processed outside Malaysia by RideNow’s related companies, service providers and/or technology providers. RideNow will take reasonable steps to ensure that such transfers are protected by appropriate safeguards in accordance with applicable laws.

SECURITY MEASURES

We take reasonable measures to ensure that your personal data is protected, including:

  • maintaining appropriate access control and IT security measures;
  • restricting access to authorised personnel only;
  • ensuring that our employees, representatives and service providers comply with confidentiality and data protection obligations;
  • implementing reasonable safeguards against unauthorised access, disclosure or misuse; and
  • requiring third parties handling personal data to maintain appropriate confidentiality and security measures.

However, while we strive to protect your personal data, no transmission of data over the internet can be guaranteed to be completely secure.

WHETHER OBLIGATORY TO PROVIDE PERSONAL DATA AND CONSEQUENCES OF NOT PROVIDING

Where indicated (for example in our website, platform, registration forms, valuation submissions, inspection booking forms or transaction-related documents), it is obligatory for you to provide your personal data to enable RideNow to process your application, request or transaction and to provide our services to you.

Should you decline to provide or permit the processing of such required personal data, RideNow may not be able to process your request, facilitate the transaction, or provide all or part of our services to you.

COOKIES

RideNow uses “cookies”, where a small data file may be sent to your browser to store and track information about you when you access or use our website or platform. Cookies may be used to collect information such as the number of users, frequency of visits, user preferences, browsing activities and usage patterns to improve user experience and the quality of RideNow’s services.

LANGUAGE

This Privacy Policy may be issued in both the English and Bahasa Malaysia languages. In the event of any inconsistency, conflict or discrepancy between the English version and the Bahasa Malaysia version, the English version shall prevail.
